Fired for her faith: A third CVS pharmacy nurse practitioner says she was fired for refusing to give abortion drugs

A third CVS pharmacy nurse practitioner claims she was terminated for refusing to provide abortion drugs because of her religious beliefs.

A former nurse practitioner at a Virginia MinuteClinic is suing CVS Health, claiming that she was terminated for refusing to provide some contraceptives and abortion-inducing medicines due to her moral convictions.

Casey’s lawyers claim in legal documents filed in county circuit court that CVS, the parent company of MinuteClinic, gave the nurse permission to provide abortion-inducing contraceptives for over 2.5 years. It mentioned two of the most well-known morning-after medications, Plan B and Ella. According to the complaint, Casey was given the modification after she formally requested it on the basis of her Catholic beliefs.

According to the complaint, this policy shift occurred in August 2021, when the Rhode Island-based corporation stated that its staff may no longer avoid administering abortion-inducing medications and other kinds of birth control.

Alliance Defending Freedom is a Christian, conservative legal firm backing Casey. Senior lawyer Denise Harle remarked, “We are approaching some scary area if companies can terminate someone for practicing their religious views.” It takes two to tango, as the saying goes.

The lawsuit details Casey’s interactions with her managers after CVS announced it would no longer allow its employees to avoid prescribing the drugs, including an additional request for religious accommodation in December. Casey had been working primarily at a MinuteClinic in Alexandria, Virginia, since 2018. Company representatives reaffirmed in January and March that they would no longer meet her request.

After Casey repeatedly informed her superiors that she was unable to give medicines that may induce abortion, CVS dismissed her on April 1.

Indiana passes the country’s most restrictive abortion bill.

CVS spokesman Mike DeAngelis said in a statement that workers may make requests to the firm based on religious convictions. Workers, however, must participate in efforts to promote sexual health and avoid unwanted pregnancies.

We are unable to provide waivers for these mandatory MinuteClinic procedures, he stated.

People’s moral, ethical, and religious convictions on the morality of abortion are protected by Virginia law. Hormonal contraceptives are not specifically mentioned in the legislation.

Harle said that the section is not clear on whether or whether it protects the delivery of medications used to induce abortions, but she found Casey’s complaint presented a “straightforward argument” based on the language of the statute.

The filing this week follows the U.S. Roe v. Wade, the historic ruling that legalized abortion in the United States, was overruled by the Supreme Court in June. There have been 15 state-level bans or near-bans on abortion since then, with Indiana’s ban taking effect later this month. Proponents of abortion rights worry that politicians may also restrict access to contraception.

Republican Gov. Glenn Youngkin of Virginia stated in June that he planned to push for a ban on abortions beyond 15 weeks. Abortion and contraception are both allowed in the Commonwealth of Virginia.

Harle claims that, regardless of the court’s judgment, Casey was going to bring the litigation before Roe was overruled.

She said that the delay in the lawsuit was caused by Alliance Defending Freedom’s workload after Roe v. Wade was overturned.

According to a representative from the Alliance Defending Freedom, Casey is now unavailable for comment.
